Terms & Conditions

Welcome to Maui Real Estate School. By enrolling in our course(s) or otherwise accessing our website, platform or services, you agree to the following terms and conditions (these “Terms”). Please read them carefully.

1. Definitions

  • “Student” or “you” means any individual who enrolls in or uses our courses, platform or related services.

  • “Course” refers to any pre‐licensing, broker course, or other educational program offered by MRES.

  • “Platform” means the online learning system, website, software, apps or other tools provided by MRES.

  • “Content” means all instructional materials, videos, audio files, quizzes, tests, hand‐outs, textbooks, web materials, and any other materials provided in connection with a Course.

  • “State” refers to the State of Hawaii, unless otherwise indicated.

2. Acceptance of Terms

By registering for a Course, accessing our Platform or receiving Content, you agree to abide by these Terms and to any additional guidelines or policies that we post including refund policy, privacy policy, code of conduct, etc. If you do not agree with any portion of these Terms, do not enroll or use our services.

3. Course Enrollment & Payment

  • To enroll in a Course you must provide current, accurate information and keep your account credentials secure.

  • Payment of the applicable course fee is required before access is granted unless otherwise agreed in writing.

  • If you fail to pay any required fees, MRES may deny access or withhold completion credentials.

  • Course fees are subject to change; promotions or discounts (such as holiday sales) apply only for the stated period or as specified. Promotions are only applicable to new registrations and can not be applied retroactively to an existing account.

4. Access to Platform & Materials

  • Upon successful enrollment and payment, you will receive access credentials to the Platform for the Course.

  • Access is for your individual use only. You may not share your login or allow others to access the Course under your account.

  • All Materials are the intellectual property of MRES (or its licensors). You are granted a limited, non-exclusive, non-transferable license to use the Materials for the purpose of completing the Course.

  • You may not reproduce, distribute, publicly display, sell, modify, create derivative works from, or otherwise exploit the Materials beyond your personal learning use without our express written permission.

5. Course Completion, Certificate & State Licensing

  • Successful completion of a Course will entitle you to a certificate of completion, as required for submission to the Hawaii Real Estate Branch. 

  • It is your responsibility to verify and meet all licensing prerequisites, including but not limited to age, education, background check, application deadlines, exam scheduling, and any state licensing fees.

  • MRES does not guarantee that you will pass the licensing exam or obtain a license. The Course is designed to prepare you, but exam results may differ from student to student and licensing approval is determined by the licensing authority.

6. Student Conduct & Academic Integrity

  • You agree to engage in honest and ethical conduct in all aspects of your Course participation.

  • Cheating, plagiarism, sharing login credentials, impersonation, or other dishonest behavior is prohibited.

  • MRES reserves the right to suspend or terminate your access, void your certificate or withhold other benefits if you violate these standards.

7. Refunds, Modifications & Cancellation

  • If for any reason we cancel a Course that you are enrolled in (not due to your misconduct), we will provide you with a choice of a full refund or transfer to a future session.

  • Students who move, have personal issues, or are no longer interested in pursuing a real estate career can not receive a refund of their tuition. Students are responsible for the functionality of their own device and internet connection. MRES will make every effort to assist the student in completing the course and obtaining their license, but is not held responsible for internet outages, personal device issues, or internet issues affecting the student's area.  

  • Online self-paced courses are active from the registration date and expire 6 months from the registration date. Students may pay to extend their access for an additional 6 months and keep the progress they have made in the course for a fee ($100 plus tax).  Extension payments must be made prior to the expiration of the course. If a student wishes to extend their course after the expiration date, there is a risk that their progress may be deleted.  The extension time is applied from the date of the expiration regardless of when the payment is made.  Example 1: Your course expires on Feb 1st and you make your payment to extend the course on January 15th. Your new expiration date is Aug 1st. Example 2: Your course expires on Feb 1st and you forget to extend the course. You make your payment to extend the course on March 15th. Your new expiration date is the same date - Aug 1st.

  • Online self-paced students may upgrade their enrollment to include the Zoom Instructor Series by paying a fee ($400 plus tax) and emailing the school with the session they would like to enroll in - as long as they are an active student at the time of the Zoom course. If a student attends a Zoom series, and would like to attend another one as a refresher prior to taking their state exam, they must pay the fee ($400 plus tax) to attend. 

  • The Zoom course option with the live instructor is a live event with dates outlined on the website. Students may move their registration into another Zoom session within 48hours notice of the start date and time of the first class by notifying the school via email and paying a fee ($50 plus tax) to update their enrollment. Once the Zoom course begins, students can not move their registration to another session.

  • No Pass No Pay Policy applies to students registered for the Zoom Instructor Series, not for online self-paced students. The policy states that if a student should fail their state licensing exam, the student may take another Zoom course without making any additional payments.  The student must exercise the use within 3 months of taking the initial zoom course.  For example: Student attends the Zoom course from Sept 1 - Sept 30th. Student takes their state licensing exam on Oct 15th and does not pass. The student may attend another course without making any additional payment by Dec 30th. Courses are scheduled monthly, however, in the case that there is no course available, the student is able to take the next available course.  In the provided example, if there is no course available by Dec 30th, the student may take the January course.

8. Modifications to Courses & Platform

  • We may update, modify or discontinue Courses, Materials or Platform access at our discretion. We will make reasonable efforts to notify enrolled students of changes in a timely manner.

9. Intellectual Property & Usage Restrictions

  • All trademarks, service marks, logos, course materials and other proprietary content on the Platform are owned by MRES or its licensors.

  • You may not use our trademarks or brand identifiers without our express prior written consent.

  • You may not resell, sublicense, distribute, share, publicize or commercialize any part of the Course or Materials without explicit authorization.

10. Disclaimer of Warranties & Limitation of Liability

  • MRES does not guarantee your exam pass, license issuance, employment outcome, or any other result.

  • In no event will MRES, its directors, employees, instructors, affiliates or agents be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost license opportunity or lost data, even if advised of the possibility of such damages. 

  • The Services and Materials are provided “as is” and “as available” without warranty of any kind, either express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • Our total liability for any claim arising out of or related to these Terms will not exceed the amount you paid for the Course in question.

11. Termination

  • MRES may terminate your access to the Platform if you breach these Terms, fail to comply with payment obligations, or the term of your enrollment has expired.

  • Upon termination, you will lose access to the Online Materials and Platform. 

  • The provisions of these Terms that by their nature are intended to survive (e.g., intellectual property, limitation of liability, confidentiality) will continue even after termination.

12. Privacy & Data Protection

  • Our collection and use of your personal information are governed by our Privacy Policy (link here). By enrolling in a Course, you agree to the data practices described therein.

  • You consent to receive communications (e.g., course updates, reminders, promotions) via email, text or other methods consistent with your consent preferences.

13. Dispute Resolution & Governing Law

  • These Terms and any disputes arising out of them will be governed by and construed under the laws of the State of Hawaii, without regard to conflict of law principles.

  • Any dispute, claim or controversy between you and MRES arising out of or relating to these Terms or the Course shall be resolved by binding arbitration administered in Maui County, Hawaii, in accordance with the rules of the American Arbitration Association or other mutually agreed‐upon arbitration rules. The arbitrator’s decision shall be final and binding. Each party shall bear its own costs, but the arbitrator may award reasonable attorneys’ fees to the prevailing party if permitted by the applicable rules.

  • If for some reason arbitration is found unenforceable, you and MRES agree to submit to the exclusive jurisdiction of the state or federal courts located in Honolulu County, Hawaii.

14. Force Majeure

  • MRES will not be liable or responsible for any failure or delay in providing the Course or Platform caused by acts beyond our reasonable control (for example: natural disasters, Internet or hosting failures, pandemics, government orders, or power outages).

15. Entire Agreement & Amendments

  • These Terms constitute the entire agreement between you and MRES regarding your enrollment in the Course and use of the Platform, superseding any prior agreements or communications.

  • We may amend these Terms at any time by posting revised terms on our website. The “Last Updated” date will reflect the latest version. Your continued enrollment or use of the Platform after posting of any changes constitutes your acceptance of such changes.
